The Insider Dealing Tribunal was replaced by the Market Misconduct Tribunal in 2003 and ceased operation from December 2009 upon completion of all cases in hand.

Introduction

The Insider Dealing Tribunal was established in 1991 under the provisions contained in section 9 of Hong Kong's Securities (Insider Dealing) Ordinance (Repealed). If the Financial Secretary was of the view that insider dealing in relation to the securities of a listed corporation had (or might have) taken place, he might require the Insider Dealing Tribunal to inquire into the matter and determine:

  • whether insider dealing in relation to the named listed corporation's securities had taken place;
  • the identity of every insider dealer; and
  • the amount of any profit gained or loss avoided as a result of the insider dealing.
